The settlement allowed him and a handful of lawyers to make $147 million in contingency fees. The company distributed discount coupons and gave cash rebates to the million owners of their notebook computers. The filing of the lawsuit took place last March for two laptop owners.

A flaw in the laptops design that could create loss or corruption of data was the claim of the two men who received $25,000 from the settlement. This laptop flaw which they claim they had in their laptops did not cause any damages or data loss at all.

The Japanese corporation which makes the chip, said it never has received a single consumer complaint about the alleged defect. There were no complaints made by any of the computer maker’s customers until the two lawyers filed the lawsuit. The company stated also that it did not encounter data loss when it ran tests.

If the Japanese computer maker had lost a jury trial, it could have cost the company more than $9 billion enough to jeopardize its future. Its capitulation in what many legal observers regard as an easily defensible case was the legal equivalent of throwing blood soaked meat into the waters of the Gulf of Mexico. The sharks moved in almost before the sound of the splash faded. In effect, more lawsuits began to emerge, this time directed against five laptop manufacturers believed to have used the NEC floppy control chip.

Copycat lawsuits are causing these non related businesses to consider layoffs. More problems would arise from this. The billion dollar settlements may cause prices of personal computers to go down, stated a New York financial analyst. A few hundred dollars are all you need to buy low priced computers that work faster and more efficiently than those models that cost thousands two decades ago.
