Personal injury law and the difference between negligence and accident

There are a variety of different types of claims which lawyers are commonly used for, two of which are for personal injuries caused by accidents and for medical negligence. These two claims are often seen as the same thing but they are far from it. There are a number of differences between these

two despite certain characteristics of negligence being present in the accident type of claim.

Whilst both types of claim can involve injuries, the source of the problem is often what differentiates between the two. Personal injury accident claims can come from a number of areas such as accidents at work which could include a breach of health and safety regulations, machinery accidents or trips and falls. This type of claim might be because the employer has not ensured the workplace is maintained to a standard which meets the regulations set out which say they must offer a safe and secure place of work.

There are a number of other personal injury accident claims which happen in public places. Public personal injury accident claims can vary from road and rail accidents to air accidents which have caused injury. These types of claims help the victim to maintain financial security and get back to where they were before the accident. These claims see compensation sought from the person who is deemed to have caused the accident.

Most often negligence claims are known for illnesses caused by medical negligence but they can deal with injuries too. Misdiagnosis for cancer and other diseases are one of the certain types of medical negligence claims. A fairly common medical negligence claim is birth injuries where long term illness of the mother or child has been caused where the medical team have failed to notice and correct problems during the birthing process.

Negligence claims are normally when there is a long term injury or illness due to poor practice by professionals. These claims are normally made on the grounds that the professionals failed to prevent an illness or accident from happening due to not doing their job properly.
