No win no fee claims are a phenomena which has gained immense popularity and media exposure in the last few years. At first it seems as if nothing can go wrong according to the adverts, naturally this gains the companies in question a lot of business, but are they really faultless, flawless, and

guaranteed to get you your rightful compensation?

The advantages of a no win no fee claim is that people with a lack of money are able to pursue their rightful compensation claims without worrying about having the house repossessed due to those extortionate lawyer’s fees. In previous years, many cases that could yield a poor person considerable funding as a result of negligence on the part of someone else have gone unheard of due to the fear of it falling through and then they are left with the bill.

Another advantage that comes with a no win no fee claim is that whoever is in charge of that specific case has to try their best as they won’t get anything if they don’t put their full effort into it. However, in previous years this wasn’t the case as they knew they were always going to get paid regardless so the quality of service you got just depended on what mood the lawyer happened to be in on that day.

However, the reality is that law firms are very selective with the claims that they choose to accept by this method. They will carefully analyse all the information presented to them at an initial meeting and base their decision on how likely they think the claim is to succeed. Claims that are particularly complex or likely to take many hours to investigate and represent will probably be refused straight away.

One point that is sometimes not known, or taken into consideration until the event occurs, is that you as a claimant, should you lose your case, be responsible for paying the defendant and the insurance is declined. Instances of this nature have been revealed by people with past experience and is a valuable consideration with “no win = no fee” actions.

The truth of the matter is that no win, no fee claims are of course a good thing but they still need to be treated with caution, if something seems to be good to be true, then it probably is.
